Terms of Service and User Agreement
Version 1.1 — Effective May 27, 2026
Please read these terms carefully. By using this website or submitting a request through it, you agree to be bound by these terms in their entirety.
Important notice: Independent service provider
PublicInformationRequests.com is an independent technology service. It is not affiliated with, endorsed by, operated by, or connected to any federal, state, county, or municipal government agency. Government agencies do not operate this website. Filing a request through this platform is equivalent in legal effect to filing directly with the agency — this platform acts as your authorized communications agent for that purpose only.
1. Parties and Acceptance
This Agreement is between PublicInformationRequests.com, operated by Factual Rational LLC, a Texas entity ("Company," "we," "us"), and you, the individual or entity using this platform ("User," "you").
By using the platform in any way — including submitting a request, creating an account, or accessing any page — you represent that:
- (a) you are at least 18 years old;
- (b) you have legal capacity to enter this Agreement; and
- (c) you agree to all terms stated here.
Acceptance is recorded electronically. Your acceptance timestamp and IP address are stored. These records constitute legally binding evidence of your agreement.
2. What This Service Is and Is Not
2.1 What We Do
We provide technology-assisted public records request services, including: drafting requests under applicable state and federal law; submitting requests to government agencies as your authorized agent; tracking statutory response deadlines; sending follow-up communications when agencies miss deadlines; receiving agency responses on your behalf; and providing document management tools for records you receive.
2.2 What We Are Not
We are not a government agency. We are not a law firm. We do not provide legal advice. Nothing on this platform creates an attorney-client relationship. Our services — including request drafting, template use, exemption guidance, appeal letter preparation, and AG complaint drafting — are document preparation and technology services, not legal services. If you need legal advice, consult a licensed attorney.
2.3 No Guarantee of Outcome or Timing
We make no representation, warranty, or guarantee regarding:
- Whether any government agency will produce records in response to any request;
- The time within which any agency will respond;
- The completeness, accuracy, or usefulness of any records produced;
- The time within which we will submit a request after you provide request information. Processing tier descriptions (Standard, Priority, Expedited) represent service targets under normal operating conditions, not binding commitments. Actual processing times may vary due to agency portal availability, verification requirements, volume, and other factors beyond our control;
- The outcome of any appeal, AG complaint, or legal referral.
Any language on this platform describing processing timeframes is a target, not a guarantee.
3. Communications Authorization
By submitting a request, you irrevocably authorize PublicInformationRequests.com to:
- Transmit your request to the designated government agency in your name via any accepted method;
- Receive, open, and process all agency communications related to your request;
- Send follow-up communications to the agency on your behalf;
- Draft and transmit escalation notices citing applicable statutory violation provisions;
- Receive documents delivered by the agency on your behalf;
- Notify you of all agency communications and status changes.
This authorization: (a) does not transfer the legal right of access to us; (b) does not alter your requester status under applicable law; (c) may be revoked by closing the request; and (d) does not obligate us to guarantee any outcome or timeline.
4. Fees, Payments, and Refunds
4.1 Service Tiers
We offer three processing tiers for each request. Tier selection occurs at submission. Fees are non-refundable once a request has been submitted to an agency except as provided in Section 4.4.
Standard Processing: No service fee. Available to all users. Processing occurs in the order requests are received, subject to operational capacity.
Priority Processing: $39 flat fee, charged at submission. Includes request review, optimization, unlimited follow-ups for 90 days, and appeal letter preparation if the request is denied.
Expedited Processing: $99 flat fee, charged at submission. Includes all Priority Processing features plus AG complaint preparation if needed and 180 days of follow-up coverage.
4.2 Government Agency Fees
Government agencies may independently charge fees for producing records under applicable law. These fees are set by the agency, not by us. When an agency quotes a fee:
- We will notify you of the fee before collecting any payment;
- We will collect the total amount including the agency fee plus a $10.00 platform service fee plus applicable card processing fees (currently 2.9% + $0.30, subject to change);
- We will remit the agency fee directly to the agency;
- We retain the service fee and card processing fee;
- You may decline to pay, in which case we will notify the agency that you are not proceeding.
We submit every request with fee waiver language by default. If the agency grants a fee waiver, no government fee is collected.
4.3 Subscription Plans
Pro, Team, and Newsroom subscription plans are available at published rates. Subscriptions auto-renew. Cancel before the renewal date to avoid the next charge. Refunds for unused subscription periods are at our sole discretion.
4.4 Refund Policy
Service tier fees ($39, $99) are non-refundable once a request has been submitted to an agency. If we are unable to submit a request due to our own error or system failure, we will refund the service fee in full. Government agency fees are non-refundable once remitted to the agency. If an agency refunds a fee it previously collected, we will pass that refund through to you minus the service fee and card processing costs already incurred.
5. Intellectual Property
5.1 Ownership
We exclusively own all right, title, and interest in this platform including: all software, source code, and algorithms; all interface designs and visual presentation; all proprietary agency databases, performance data, and behavioral intelligence; all request templates, legal language, follow-up copy, and content we create; all trademarks and trade dress; and all derivatives thereof.
5.2 Your Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use this platform solely for your personal or organizational public records needs. You may not copy, redistribute, reverse engineer, scrape, or use any part of this platform to build a competing service.
5.3 Your Content
You retain rights to: (a) the text of requests you draft; and (b) records you receive from government agencies. You grant us a limited license to process and store this content solely to provide our services.
5.4 Public Archive
Free-tier requests are included in our public document archive by default. You grant us a perpetual license to index and display public request descriptions and responsive records. You may mark any request private before archive inclusion. Paid tier requests are private by default.
5.5 Enforcement
We actively monitor for unauthorized use and will pursue all available remedies for IP violations including injunctive relief.
6. User Obligations
You represent and warrant that:
- All information provided is accurate, including your name as it will appear on requests;
- You are the named requester or have written authorization to file on their behalf;
- You will not use this platform for unlawful purposes or to harass government employees;
- You will not submit requests without genuine intent to receive the records;
- For states requiring requester residency, you meet that requirement or have arranged for a qualified resident or attorney to file on your behalf;
- You will not attempt to circumvent any security or access controls.
7. Attorney Referral
We may refer you to licensed attorneys in our network when your situation requires legal representation or advice. Referrals are free to you. We may earn a referral fee from the attorney if you engage their services. We are not responsible for outcomes of any attorney-client relationship.
8. Disclaimers
The platform is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or that any defects will be corrected.
We make no warranty that any public records request will result in the production of records, that any government agency will comply with any deadline, or that any appeal will be successful.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from this Agreement or your use of the platform shall not exceed the greater of: (a) the total fees you paid to us in the 12 months preceding the claim; or (b) one hundred dollars ($100.00).
We shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, loss of data, or loss of goodwill, whether in contract, tort, or otherwise, even if advised of the possibility of such damages.
10. Indemnification
You agree to defend, indemnify, and hold harmless PublicInformationRequests.com and its officers, directors, employees, contractors, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the platform; (b) your violation of this Agreement; (c) any content you submit; or (d) your violation of any third-party rights.
11. Privacy
We collect your name, email address, request content, and received documents. We do not sell personal information. Your name and request description become part of a government record once filed and are subject to that agency's disclosure rules, which we do not control. See our Privacy Policy for full details.
12. Termination
We may suspend or terminate your account at any time for any reason. Sections 5, 8, 9, 10, and 13 survive termination.
13. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the State of Texas, without regard to its conflict of law provisions.
Any dispute arising from or relating to this Agreement shall be resolved by binding arbitration under the American Arbitration Association's Consumer Arbitration Rules, conducted in Austin, Texas. You waive your right to a jury trial and to participate in any class action.
14. Changes to These Terms
We may update these Terms at any time. Material changes will be communicated via email or site notice at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.
